1. Service Description

Vinny (“the Service”) is an AI-powered wine concierge that provides wine recommendations, food pairing suggestions, and educational content (“we,” “us,” or “our” refers to the operator of Vinny). The Service is not a licensed sommelier, dietitian, medical professional, or alcohol retailer.

2. AI Disclaimer

Vinny uses artificial intelligence to generate wine recommendations and information. All AI-generated content is provided “as-is” without warranty of any kind. Recommendations may be inaccurate, incomplete, or outdated. You should not rely solely on Vinny for purchasing decisions, dietary choices, or allergen safety.

Wine data is sourced from public databases, third-party APIs, and AI model training data. We do not guarantee the accuracy, completeness, or timeliness of any information provided. Vinny is not a substitute for professional wine, dietary, medical, or allergen advice.

3. Age Requirement

You must be 21 years of age or older to use the Service. By using Vinny, you confirm that you meet this age requirement. We reserve the right to terminate access for any user who does not meet this requirement.

4. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or extract source code from the Service; (c) use automated systems to scrape, crawl, or extract data from the Service beyond normal use; (d) interfere with the proper functioning of the Service; or (e) impersonate any person or entity.

5. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from your use of the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to damages arising from wine recommendations, food pairing suggestions, or allergen information provided by the Service.

6. Restaurant Terms

Restaurants and hospitality businesses (“Restaurant Partners”) that use Vinny to assist their guests acknowledge that: (a) the Restaurant Partner is solely responsible for maintaining valid liquor licenses and compliance with all applicable alcohol regulations; (b) the Restaurant Partner is responsible for the accuracy of their wine menu and inventory as entered into the Service; (c) the Restaurant Partner is responsible for allergen handling and disclosure to their guests; and (d) Vinny facilitates wine discovery and education but does not sell, distribute, or serve alcohol.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Intellectual Property

The Vinny name, logo, and all associated branding are the property of their respective owner. You retain ownership of any content you submit to the Service (such as tasting notes). We retain ownership of AI-generated content and aggregated analytics data.

9. Termination

Either party may terminate use of the Service at any time. We reserve the right to suspend or terminate your access for violations of these Terms. Upon termination, you may request deletion of your account data by contacting us.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.
